Boating Accident Cases

Boating and jet ski accidents can turn a fun day on the water into a life-changing tragedy. Speed, inattention, alcohol, and reckless operation are the leading causes of boating crashes and water-related injuries. At RedStone Law, our attorneys — Mike, Morgan, and Mark — represent victims of boating and watercraft accidents throughout Kentucky and Tennessee.

These cases often resemble motor-vehicle collisions in how fault, evidence, and liability are determined, but they also involve unique maritime and state-specific regulations. Our team knows the boating laws, the insurance companies, and the courts, and we have the experience to secure the compensation you deserve.

With offices in Clarksville, TN, and Hopkinsville, KY, we serve clients across both states who have suffered serious injuries or wrongful death on the water.

Our Six-Step Approach to Boating Accident Cases

1. Investigate the Scene Immediately
We visit the accident site as soon as possible to document the scene before vital evidence disappears. Even minor details — like wake patterns, debris placement, or GPS data — can be crucial.

2. Interview Witnesses and Law Enforcement
Our retired police investigator and legal team conduct thorough interviews and review all reports for inconsistencies or bias.

3. Secure Photos, Video & “Black Box” Data
We collect video from marinas, docks, or other nearby cameras, and preserve onboard electronic data (“black box”) from involved vessels whenever possible.

4. Preserve Evidence Held by the At-Fault Operator or Insurer
We send legal preservation letters immediately to prevent the destruction of vital records, such as boating logs, maintenance history, or insurance communications.

5. Provide a Free Case Evaluation
We explain your rights, assess your damages, and answer your questions about timelines, fault, and compensation — all at no cost.

6. Deliver a Customized Plan of Action
Once you hire us, we prepare a personalized legal strategy with clear next steps. You’ll have access to your RedStone Law Client Portal 24/7 for case updates and direct communication with our team.

“We believe in transparency, responsiveness, and advocacy — on land or water.”

How DOES redstone LAW Determine fault for a Boating case?

Every boat operator has a legal duty to act responsibly and protect others on the water. We investigate and prove fault when operators:

  • Drive too fast for water or weather conditions
  • Operate under the influence of alcohol or drugs
  • Fail to maintain a proper lookout
  • Ignore navigational rules or warning buoys
  • Jump wakes dangerously or weave through crowded waters
  • Fail to provide life jackets or proper safety equipment
  • Operate recklessly at night or near swimmers

When necessary, we also pursue claims involving rental companies, marinas, or manufacturers if their negligence or faulty equipment contributed to the crash.

WHAT DOES redstone LAW help boating accident victims?

We manage every aspect of your case, from investigation to negotiation or trial:

  • Gather and preserve key evidence, including GPS and sonar data
  • Document serious injuries like brain trauma, fractures, or spinal damage
  • Work with boating safety and reconstruction experts to determine cause and liability
  • Create clear, persuasive visual presentations for insurance adjusters or juries
  • Negotiate aggressively for full compensation — or litigate when necessary

Our in-house media team transforms your case evidence into visuals that clearly explain what happened and why justice is warranted.

Insurance Company Tactics

Insurance adjusters often attempt to:

  • Blame victims for causing their own injuries
  • Claim boating rules don’t apply or are unclear
  • Downplay injury severity or delay payment
  • Offer quick but low settlements before the full extent of injuries is known

Our attorneys recognize these tactics and fight to ensure you receive a fair and full recovery.

HOW IS redstone LAW PAID?

You pay nothing upfront.

We work on a contingency fee basis, meaning our payment is a percentage of your settlement or verdict. While many firms charge 40%, our fee is one-third (1/3) — a rate we’ve maintained for over 25 years.

All fees are transparent and in writing, with no hidden terms. You’ll receive:

  • A free consultation and detailed case evaluation
  • 24/7 client portal access for updates
  • Direct communication with our attorneys
  • Experienced paralegal support averaging 10+ years

With decades of combined experience in personal injury and wrongful death cases across Kentucky and Tennessee, RedStone Law stands ready to represent you after a boating accident.

KENTUCKY and tennessee boating LAWs

Kentucky Law – KRS §235.285
Kentucky law requires all boaters and passengers on personal watercraft to wear a U.S. Coast Guard-approved life jacket. It prohibits:

  • Reckless operation, weaving through congested areas, and wake-jumping
  • Operation between sunset and sunrise
  • Allowing minors under 12 to operate vessels over 10 horsepower without proper certification
  • Operating without a lanyard-type engine cutoff switch or self-circling capability

Operators must always act in a reasonable and prudent manner to protect human life and property on the water.

Tennessee Law – T.C.A. §69-9-504
Tennessee requires personal watercraft to be operated safely and prohibits reckless maneuvers, including:

  • Weaving through congested traffic at high speeds
  • Cutting too close to other vessels or people being towed
  • Jumping wakes within 100 feet of another vessel
  • Steering toward swimmers or vessels and turning sharply to spray them

Operators must also maintain a safe distance from other boats and immediately respond to orange warning flags signaling a hazard.

Both states emphasize safe, responsible boating, and hold negligent operators accountable when their carelessness causes injury.
